1. Agreement: By submitting a narrative (“Narrative”), the participant (“you” or “Particpant”) accepts these terms and conditions (the “Terms and Conditions”), which are fully and unconditionally binding in all respects. You are providing the Narrative as part of a marketing program operated by MH Sub I, LLC, dba LawFirms.com (“we” or “us”) and, if eligible, a gift card will be processed by Tremendous LLC or another vendor (the “Program”). The Program is subject to these Terms and Conditions and all amendments, operating rules, or policies herein. We reserve the right to update and change these Terms and Conditions at any time, with or without notice to you. We also reserve the right to refuse, withdraw, or disqualify any submission at any time at our sole discretion. You represent and warrant that you are eligible to participate based on the eligibility requirements explained herein. You also agree to accept our decisions as final and binding.
2. Eligibility and Rules: The submission of a Narrative is open to legal residents of the 48 contiguous United States and the District of Columbia who provide a valid and complete description of the Participant's motor vehicle accident. A “Qualified Lead” means a Participant who is 18 years of age or older at the time of the motor vehicle accident and such accident must have occurred in the United States within 24 months from the date of the submission of the Narrative. This Narrative is subject to the terms herein, federal, state, and local laws and regulations and void where prohibited by law.
Eligible Participants may submit a Narrative, via the online form provided, which shall include the Participant’s first and last name, email, phone number, and a detailed description of the Participant’s involvement in a recent motor vehicle accident. Each Participant shall only submit one Narrative per accident. Each Participant must provide his/her own email account. Multiple Narratives submitted for the same accident or from the same email account will be disqualified from eligibility and no gift card will be provided. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any Narrative or gift card, the authorized submitter of the Narrative will be the registered owner of the email account that was used in the submittal of such Narrative. All submittals become our property and will not be acknowledged or returned. We retain sole discretion in determining the eligibility of a Narrative and whether it qualifies for a gift card, with or without notice. You agree that we will not be liable to you or any third-party for any modification or discontinuance of the Program.
We shall determine, in our sole discretion, any cases of suspected abuse, fraud, or violation of these Terms and Conditions and any decision made by us shall be final and binding. Fraud or abuse relating to the Narrative or redemption of a gift card may result in forfeiture of any gift card as well as the termination of the Narrative. We reserve the right to pursue any legal remedies for abusive or fraudulent activity.
IT IS CONSIDERED BOTH FRAUDULENT AND ABUSIVE FOR ANY INDIVIDUAL OR COMPANY TO DIRECT, ENCOURAGE, OR ALLOW INDIVIDUALS TO PROVIDE FALSE OR MISLEADING NARRATIVES OR INFORMATION FOR THE PURPOSE OF RECEIVING A GIFT CARD.
3. Payment: WE ARE A LEGAL MARKETING SERVICE AND ARE NOT A LAW FIRM. GIFT CARD PAYMENT SHALL BE SOLELY MADE VIA OUR PAYMENT PARTER TREMENDOUS, LLC OR ANOTHER VENDOR. NO LAW FIRM OR ATTORNEY IS INVOLVED IN ANY SUCH PAYMENT NOR SHOULD YOU REQUEST ANY PAYMENT FROM A LAW FIRM OR ATTORNEY.
Once your Narrative is properly submitted and deemed eligible based on these Terms and Conditions, you will receive a Visa gift card, which will be sent to you online within several minutes of the completion of your Narrative. The gift card will be sent via a pop up message that will enable you to access the gift card online via a linked token. There shall be no cash or other payment substitution permitted except at our discretion. Your acceptance of the gift card indicates that you are solely responsible for all expenses related to the gift card, including, without limitation, any and all local, state, and federal taxes. You shall not transfer assignment of the gift card to others nor shall you request the cash equivalent for the gift card.
4. Rights Granted: By submitting your Narrative, you represent that the information set forth in your Narrative is true, accurate, current and complete. You understand and agree that we, or any individual acting on the our behalf, and our licensees, successors, and assigns, shall, where permitted by law, have the right to print, publish, broadcast, distribute and use in any media known now or hereafter developed, in perpetuity, worldwide, and without limitation, your submission, name, any submitted photo, portrait, voice, likeness, image, statements about the Narrative, and your information for advertising, promotional purposes, or to attempt to fulfill any request to be connected to an attorney, without any further notice, review, consent, compensation, or remuneration. You acknowledge and agree that we may disclose certain personal information provided by you as part of the Narrative to third parties as needed for the delivery of the gift card. By submitting your Narrative, you consent to be contacted, by manual or automated means, via text, phone and/or email by Us and our partners and up to 3 participating attorneys in our network.
5. Disclaimer of Warranties: ALL MATERIALS, INFORMATION, PRODUCTS, AND SERVICES INCLUDED IN OR MADE AVAILABLE THROUGH THIS PROGRAM ARE PROVIDED AS IS; AND, AS AVAILABLE. THIS PROGRAM IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT. IN ADDITION WE, DO NOT WARRANT THAT THE CONTENT, PROCEDURES, OR ACTIVITIES INVOLVED IN THIS PROGRAM ARE ACCURATE, RELIABLE, OR CORRECT; OR THAT ANY DEFECTS OR ERRORS WILL BE CORRECTED. YOUR INVOLVEMENT IN THIS PROGRAM IS SOLELY AT YOUR RISK.
UNDER NO CIRCUMSTANCES SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING FROM THIS PROGRAM.
6. Miscellaneous: We are not responsible for: (a) any incorrect or inaccurate information or technical failures of any kind, (b) unauthorized human intervention in the submission of your Narrative; or (c) any other computer, network, technical, human or other error, problem or malfunction that may occur in connection with the Narrative. We reserve the right, at our sole discretion, to cancel, terminate, modify, or suspend this Program. Participants who tamper with or attempt to tamper with the operation or entry process of any of the Narrative submissions violate these terms and will be disqualified in our sole discretion. Your submission of a Narrative or acceptance of any payments or consideration constitutes your agreement to release and hold us harmless from any and all claims, liability, illness, injury, death, litigation, loss, or damages that may occur, directly or indirectly from participation in this Program. These Terms and Conditions are governed by the state and federal laws of the State of California. You agree that if any disputes cannot be resolved between you and us, they shall be individually resolved exclusively before a court located in Los Angeles, CA, without resorting to any form of class action. You hereby waive all rights to punitive, incidental, or consequential damages, including reasonable attorney’s fees. You waive all rights to have damages multiplied or increased.
